These Terms and Conditions (“Terms”) govern your access to and use of websites, online services, and other digital resources operated by the USA Federation for Sport Cheering (“USA Cheer,” “we,” “us,” or “our”), including usacheer.org (collectively, the “Services”).
By accessing or using the Services, creating an account, purchasing a membership, registering for an event or course, or otherwise using the Services, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.
1. USA Cheer Services
USA Cheer provides information and services related to cheerleading, STUNT, athlete safety, education, membership, events, training, certification, national teams, and other programs and activities.
Certain Services may be subject to additional terms, policies, eligibility requirements, waivers, releases, codes of conduct, rules, or agreements. Those additional requirements are incorporated into these Terms when applicable to your use of the particular Service.
2. Membership and USA Cheer Policies
Membership in USA Cheer is subject to applicable membership requirements and USA Cheer policies, which may include eligibility requirements, background screening, education or training requirements, athlete protection policies, codes of conduct, disciplinary procedures, grievance procedures, and other policies adopted or amended by USA Cheer from time to time.
Submitting an application, creating an account, or paying a fee does not by itself guarantee membership, certification, eligibility, event participation, or any other status or benefit.
These Terms do not replace or modify USA Cheer bylaws, codes, rules, policies, procedures, waivers, or other governing documents applicable to members, applicants, participants, coaches, officials, or other individuals. If these Terms conflict with a specific USA Cheer governing document applicable to a particular matter, the applicable governing document will control with respect to that matter.
3. Accounts
Some Services require an account. You agree to provide accurate and complete information and to keep your information reasonably current.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. You may not impersonate another person, create an account using false information, or allow another person to use your credentials in a manner that violates USA Cheer requirements.
USA Cheer may restrict, suspend, or terminate access to an account when reasonably necessary to protect the Services, enforce applicable policies, address suspected misuse or unauthorized access, or comply with legal obligations.
4. Minors
Some USA Cheer programs and Services are available to minors.
A parent or legal guardian may be required to create or manage an account, provide consent, register a minor, or agree to additional terms on the minor’s behalf.
Information concerning children under age 13 is handled in accordance with the USA Cheer Children’s Privacy Statement and applicable law.
5. Fees, Purchases, and Refunds
Certain memberships, courses, event registrations, products, or other Services require payment.
Prices, payment requirements, cancellation terms, and refund eligibility are governed by the terms presented at the time of purchase and any applicable USA Cheer refund or cancellation policy.
Products or services purchased through a third-party provider or separately operated store may also be subject to that provider’s terms, privacy policy, shipping policy, and return policy.
6. Courses, Certifications, and Educational Materials
USA Cheer provides educational materials, training programs, courses, safety information, certifications, and other credentials.
Completion of a course or receipt of a certification or credential does not excuse an individual from complying with applicable laws, rules, USA Cheer policies, safety standards, organizational requirements, or subsequent changes to those requirements.
USA Cheer may suspend, revoke, or otherwise modify a certification or credential when:
- The holder is suspended, disciplined, or found ineligible under an applicable USA Cheer policy and suspension or revocation of the credential is appropriate to the circumstances or disciplinary outcome;
- The holder is found to have violated requirements, standards, rules, or policies that are material to the certification or credential; or
- USA Cheer determines that continued recognition of the certification or credential would be inconsistent with the purpose, standards, or integrity of the certification program.
For example, a USA Cheer Safety & Risk Management certification may be suspended or revoked when an individual repeatedly, knowingly, or materially violates applicable USA Cheer safety rules or restrictions.
If a certification or credential is a requirement for a particular USA Cheer membership type, suspension, revocation, or expiration of that certification or credential may affect the individual’s eligibility for or continued status in that membership category.
Any suspension or revocation of a certification that is imposed as part of a disciplinary matter will be handled in accordance with any applicable USA Cheer policies and procedures governing that matter.
Users are responsible for confirming the certification, education, and other requirements that apply to their particular program, school, organization, association, event, membership category, or jurisdiction.
7. Safety, Rules, and Informational Content
Cheerleading, STUNT, and related athletic activities involve inherent risks.
Information provided through the Services is intended for educational and informational purposes and is not a substitute for appropriate coaching, supervision, professional medical advice, legal advice, emergency care, or compliance with applicable rules and safety requirements.
USA Cheer may update rules, policies, educational materials, and other information from time to time. When a webpage summarizes an official rule, policy, or governing document, the official document controls in the event of a conflict.
Nothing in these Terms replaces any separate assumption-of-risk agreement, participant waiver, release, medical authorization, or other agreement required for participation in a USA Cheer program or event.
8. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation;
- Impersonate another person or misrepresent your identity or affiliation;
- Attempt to gain unauthorized access to an account, system, database, or restricted area;
- Introduce viruses, malicious code, or other material intended to disrupt or damage the Services;
- Interfere with the operation or security of the Services;
- Collect, scrape, harvest, or systematically extract information from the Services without authorization;
- Use member directories, eligibility information, contact information, or other data obtained through the Services for unauthorized marketing, harassment, discrimination, or other improper purposes;
- Copy, reproduce, distribute, or commercially exploit USA Cheer content except as permitted by law or with USA Cheer’s permission; or
- Use the Services in a manner that infringes the rights of USA Cheer or any other person.
USA Cheer may take reasonable measures to prevent or address prohibited use.
9. Intellectual Property
Unless otherwise indicated, the content available through the Services, including text, graphics, logos, photographs, videos, course materials, publications, designs, databases, and other materials, is owned by or licensed to USA Cheer and is protected by applicable intellectual-property laws.
USA Cheer names, logos, trademarks, service marks, and other brand elements may not be used in a manner that suggests endorsement, affiliation, certification, or authorization without permission from USA Cheer.
Nothing in these Terms prevents uses permitted by applicable law.
10. Information and Materials Submitted to USA Cheer
When you submit information through the Services, you represent that you have the right to provide that information and that the information you provide is not knowingly false or misleading.
Materials intentionally submitted for public use or publication by USA Cheer may be used for the purpose for which they were submitted.
Reports of misconduct, athlete-protection matters, grievances, background-screening information, membership records, and other confidential or sensitive submissions are not considered materials submitted for public use. Such information will be handled in accordance with applicable USA Cheer policies, procedures, privacy practices, and legal obligations.
11. Third-Party Websites and Services
The Services may contain links to websites, platforms, products, or services operated by third parties.
USA Cheer does not control third-party websites or services and is not responsible for their content, security, availability, privacy practices, or terms. A link or reference to a third party does not necessarily constitute an endorsement by USA Cheer.
Your use of third-party services is subject to the terms and policies of the applicable third party.
12. Privacy
Your use of the Services is also subject to the USA Cheer Privacy Policy and, where applicable, the USA Cheer Children’s Privacy Statement.
13. Availability and Changes to the Services
USA Cheer may add, modify, suspend, or discontinue portions of the Services from time to time.
We do not guarantee that every Service, webpage, document, course, account feature, or other resource will always be available or free from interruption or error.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
USA Cheer does not warrant that the Services will be uninterrupted, error-free, completely secure, or suitable for every user’s particular purpose.
Nothing in this section limits any rights or warranties that cannot legally be excluded.
15. Limitation of Liability
To the fullest extent permitted by applicable law, USA Cheer and its officers, directors, employees, volunteers, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to the use of, or inability to use, the Services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
16. Enforcement and Termination
USA Cheer may restrict or terminate access to the Services when a user violates these Terms, threatens the security or operation of the Services, engages in unauthorized activity, or when restriction is otherwise reasonably necessary.
Termination of access to the website or an online account is separate from any membership, eligibility, disciplinary, or grievance determination governed by another USA Cheer policy unless the applicable policy provides otherwise.
17. Changes to These Terms
USA Cheer may revise these Terms from time to time.
When the Terms are revised, the “Last Updated” date at the top of this page will be changed. Material changes may also be communicated through the website, account notices, email, or other appropriate means.
Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
Failure by USA Cheer to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.
