USA Cheer Children’s Privacy Statement

Last Modified: 5/1/2024

USA Cheer values the privacy of children and of all of its users. This COPPA Privacy Policy (“COPPA Policy”) is designed to comply with the Children’s Online Privacy Protection Act (“COPPA”) and contains important information about how we collect, use, and disclose the personal information we collect from children under 13 years old who are members of USA Cheer.

In certain circumstances USA Cheer allows children under 13 years of age to sign up for a USA membership with the consent of the child’s guardian. This COPPA Privacy Policy applies to the information we collect from children under 13 when they sign up for a USA Cheer membership.

USA Cheer will handle children’s personal information as described in this COPPA Policy. Any personal information we collect about other users (e.g., teens and adults) will be treated in accordance with the USA Cheer Privacy Policy (“Privacy Policy”). The use of our Site and any dispute over privacy, is subject to this COPPA Policy, the Privacy Policy, and our Terms & Conditions, including its applicable limitations on damages and the resolution of disputes. Our Terms & Conditions and Privacy Policy are incorporated by reference into this COPPA Policy.

BY USING OR ACCESSING OUR SERVICES, OR BY PERMITTING YOUR CHILD TO USE OR ACCESS OUR SERVICES, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS POLICY.

On the USA Cheer Membership, a Parent will have the option to do some, if not all, of the following:

  • Create an account that includes personal and/or profile information
  • Register your child online for membership
  • Receive certain notifications
  • Upload a photo of your child to their membership account

The services are available to children under the age of 13 only with parental or guardian consent. The services are intended for parents or adult use until a child reaches the age of 13. Certain services can be used by children under the age of 13 only with significant parental involvement, oversight and approval.

Children under the age of 13 are not allowed to use USA Cheer services without a guardian’s permission. Children may only have a child account that is established by, and with the permission of, a parent or guardian.

Parental Consent. USA Cheer is required by COPPA to use reasonable efforts to ensure that before we collect any personal information from a child, the child’s guardian receives notice of and consents to our information practices. As a parent, you should know that through the USA Cheer services children under the age of 13 may participate in activities that involve the collection or use of personal information. However, children may not participate in any Site activities without a parent’s permission.

If your child is under age 13, USA Cheer must have “verifiable parental consent” before we collect and use your child’s personal information. We do this through the parent’s registration and payment for their child’s participation in USA Cheer, which may include without limitation as a member of a team or club.

Information We Collect and How We Collect It. The USA Cheer Privacy Policy and Terms & Conditions sets forth the information we collect for both children and those who are over the age of 13. This information is collected in the same manner regardless of age but in the instance of a child under 13, only with the Parent’s consent.

Chat, Newsgroups, Bulletin Boards and Kids

Chat, newsgroups, and bulletin boards offer children and parents alike the unique opportunity to make friends and talk to people all over the world. Please remember, though, that these interactive features are just like other public places where strangers meet. If you allow your children to access interactive features, please remind them of the dangers involved when corresponding or communicating with strangers or new acquaintances on the Internet (especially in Chat and Newsgroups, as well as when using e-mail).

You must supervise your children’s activities on these areas as you would in any public area. You should help your children understand that people they do not know will be reading their notes. They should be careful when choosing what to post (particularly information about themselves), as well as when choosing the people with whom they correspond.

Tracking Activities on the Site. When your child is logged into his or her account, we may track your child’s activities within the Site. For example, we track the pages visited, the length of time spent logged in, the information submitted about preferences . This information is associated with your child’s account and may be combined with the personal information we collect from him or her.

Parents may request information from us on the type of data being collected, view their child’s information, and, if they choose, prohibit us from making further use of their child’s information. For more information on how to do this, see the section below entitled “How To Review, Delete or Alter the Information Collected From Your Child.”

How To Review, Delete or Alter the Information Collected From Your Child. You can review your child’s personal information at any time by logging into their account or profile. You may remove access for your child OR delete your child’s account entirely. You can also have your child’s personal information deleted and refuse to permit further collection of such information by us.

If you wish to view, delete or modify the information we have collected about your child or delete your child’s account or profile, you may do this by logging in to your account at any time, or by e-mailing us at membership@usacheer.org.

Data Security. USA Cheer cares about the security of your information, and uses commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all information collected through the USA Cheer services. However, no security system is impenetrable and we cannot guarantee the security of our systems. In the event that any information under our control is compromised as a result of a breach of security, USA Cheer will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Changes to this Children’s Privacy Policy. USA Cheer reserves the right to amend this policy at any time. Please check this page periodically for changes. We will post a date of when this policy changes to alert users that a new policy is in place. If we intend to use or disclose your child’s personal information in a manner materially different from that stated at the time of collection, we will notify you via email and obtain your consent to such changes.
